These Terms of Use (“Terms”) govern your access to and use of the Environmental Working Group mobile application (the “App”), including any paid features, subscriptions, or services offered through the App (collectively, the “Services”). The App is operated by the Environmental Working Group (“EWG,” “we,” “us,” or “our”).
These Terms supplement and incorporate by reference EWG’s general Legal Disclaimer, which governs use of EWG’s websites and other digital properties. In the event of any conflict between these App Terms of Use and the Legal Disclaimer, these App Terms of Use control with respect to use of the App and any Paid Services.
By downloading, accessing, or using the App, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you may use the App only with the consent of a parent or legal guardian.
2. Paid Services and Subscriptions
EWG offers certain features of the App through paid subscriptions and/or one-time purchases (“Paid Services”).
- Subscription Term. Subscriptions are offered on an annual basis unless otherwise stated at the time of purchase.
- Billing and Payment. All payments for Paid Services are processed through the Apple App Store (for iOS users) or Google Play (for Android users). EWG does not process or store your payment information.
- Auto-Renewal. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period.
- Cancellation. You may manage or cancel your subscription through your App Store or Google Play account settings.
- No Refunds by EWG. Refund requests are handled solely by Apple or Google in accordance with their respective refund policies. EWG does not issue refunds for subscriptions or one-time purchases.
3. Free Trials
EWG may offer free trial periods for certain subscription plans. If you do not cancel before the end of the free trial, your subscription will automatically convert to a paid subscription and your payment method will be charged by the applicable app store.
4. Use of the App
You agree to use the App only for lawful purposes and in accordance with these Terms. You may not:
- Attempt to interfere with or disrupt the App or its security features
- Copy, modify, distribute, sell, or lease any part of the App
- Use the App in a manner that infringes EWG’s intellectual property rights
5. Intellectual Property
All content, features, and functionality in the App, including text, graphics, logos, and software, are owned by or licensed to EWG and are protected by copyright, trademark, and other laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
6. Disclaimer of Warranties
The App and its content are provided “as is” and “as available.” EWG makes no warranties, express or implied, regarding the App, including warranties of accuracy, reliability, or fitness for a particular purpose.
7. Limitation of Liability
To the maximum extent permitted by law, EWG shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the App or Paid Services.
8. Termination
EWG may suspend or terminate your access to the App at any time if you violate these Terms or misuse the App. Termination does not entitle you to a refund of any subscription fees.
9. Privacy
Your use of the App is also governed by EWG’s Privacy Policy, which explains how we collect, use, and protect your information.
10. Apple and Google Platform Terms
If you download the App from the Apple App Store, your use of the App is also subject to Apple’s standard End User License Agreement. If you download the App from Google Play, your use is subject to Google Play’s applicable terms. In the event of a conflict, these Terms govern your relationship with EWG.
11. Governing Law
These Terms are governed by the laws of the District of Columbia.
